| In the new Georgian Patent Law, which came into force on May 1,
1999, a so-called "Patent of Importation" is provided for (articles 4 and 5): Precondition for the registration of a patent of importation is a foreign basic patent of a foreign patent holder, which has been granted upon examination of all requirements for patentability. The patent of importation entitles the patent holder to exclusively use, produce and sell the subject matter of the patent of importation, but not to prohibit the import of the invention by a third party. The duration of the patent of importation expires with the duration of the basic patent, but in no case later than ten years after the filing with the Georgian Patent Office. The following documents have to be filed with the application: - patent certificate and patent print of the basic patent, certified by the patent office of the country, in which the basic patent was issued, - a document, confirming the validity of the basic patent, - a power of attorney for the Georgian representative, - a Georgian translation of the above-mentioned documents, which can be filed subsequently within two months after the filing date. |
