Supplementary Protection Certificate in Lithuania

Since January 1, 2002, the new article 27 (1) for request for Supplementary Protection Certificate has entered in force. Such a Supplementary Protection Certificate may be applied for:

- active ingredients of a medicine, or
- active substances of a plant protection product.

A patent owner or his successor may have a supplementary title for a period of not exceeding five years.

Basis for issuing a Supplementary Protection Certificate (SPC) is a first authorisation to place a medicine or the plant protection product on the market.

The granted certificate shall take effect at the end of the patent term for a period equal to the period which elapsed between the date on which the patent was lodged and the date of the authorisation to place a medicine or a plant protection product on the market., reduced by a period of five years, but not exceeding five years from the date on which it takes effect.
